Definitions

  • "App" refers to the SE Home mobile application.
  • "Company" refers to SecretEye Telematics Pvt Ltd.
  • "User" refers to any individual accessing or using the App.

Eligibility & Age Requirements

The App is rated 4+ and may be accessed by minors solely under parental or legal guardian supervision.

Account creation, consent management, and payments must be conducted by individuals aged 18 years or above.

Parents or legal guardians accept full legal responsibility for minors added to their accounts.

Scope of Services

SE Home is a connectivity and location-based safety assistance tool.

Services include live location sharing, SOS alerts, family tracking, and in-app messaging.

The Company does not guarantee uninterrupted service, accuracy, or safety outcomes.

Emergency & No-Assumption Disclaimer

SE Home is not a law-enforcement, emergency response, medical, or rescue service.

Users acknowledge that reliance on the App does not replace contacting local emergency services.

User Consent & Lawful Use

Users must obtain explicit, informed consent before tracking any individual.

Use of the App for harassment, stalking, surveillance, or unlawful activity is strictly prohibited.

Location Accuracy & Technical Limitations

Location data accuracy depends on GPS, device hardware, operating systems, network connectivity, and third-party services.

Delays, inaccuracies, or service interruptions may occur and are outside the Company’s control.

Third-Party Services & Dependencies

The App integrates with third-party services such as mapping providers, telecom networks, and app marketplaces.

The Company disclaims liability arising from failures or interruptions of such third-party services.

Subscriptions, Billing & Taxes

SE Home operates on a freemium model with optional paid yearly subscriptions denominated in INR.

Subscriptions auto-renew unless cancelled before the billing period ends.

Applicable taxes may be charged as per Indian law.

No Refund Policy

All subscription fees are non-refundable once activated, irrespective of usage.

Indemnification

Users agree to indemnify and hold harmless the Company, its directors, officers, and employees from claims arising from misuse, violation of laws, or breach of these Terms.

Force Majeure

The Company shall not be liable for delays or failures caused by events beyond reasonable control including natural disasters, governmental actions, internet outages, or system failures.

Limitation of Liability

To the fullest extent permitted by law, the Company’s total liability shall not exceed the subscription fees paid by the User in the preceding twelve months.

Suspension & Termination

The Company may suspend or terminate access without notice to protect legal, operational, or security interests.

Arbitration & Dispute Resolution

Disputes shall be resolved through arbitration seated in Jaipur, Rajasthan, in accordance with Indian arbitration laws.

Courts shall have jurisdiction solely for enforcement of arbitral awards.

Governing Law & Jurisdiction

These Terms shall be governed by Indian law.

Exclusive jurisdiction lies with courts of Jaipur, Rajasthan, India.

PRIVACY POLICY

Information Collected

Personal data may include name, phone number, email address, live GPS location, limited historical GPS location, and device identifiers.

Legal Basis for Processing

Data is processed based on user consent and legitimate business interests related to safety, connectivity, and service delivery.

Location Data Processing

Location data is collected only with explicit user permission and such permission may be revoked at any time through device or application settings.

In addition to live location, SE Home may store limited GPS location history for safety, operational, troubleshooting, and service improvement purposes. Location history is retained only for a limited duration and is not stored indefinitely.

Data Storage & Security Measures

The Company employs reasonable administrative, technical, and physical safeguards to protect personal data. However, no system is completely secure and absolute protection cannot be guaranteed.

Data Sharing & Disclosure

The Company does not sell personal data. Data may be disclosed to government or law enforcement authorities when legally required.

Data Retention & Deletion

Data is retained only as necessary for service provision. Upon account deletion, personal data, including location history, is deleted within up to 30 days unless retention is legally mandated.

Children’s Privacy

The App is rated 4+. Data of minors is processed solely under parental or legal guardian consent and control.

Limitation of Liability

The Company shall not be liable for data breaches occurring beyond the scope of reasonable security controls.

SUBSCRIPTION & REFUND POLICY

Subscription Plans

SE Home offers free and paid subscription plans. Paid subscriptions provide access to premium features for a specified duration, as displayed within the application.

Billing & Payments

Subscription fees are charged in advance through authorized app marketplaces or payment gateways. All prices are displayed within the app and may be subject to applicable taxes.

Auto-Renewal

Subscriptions may automatically renew at the end of the billing period unless cancelled by the user before the renewal date. Users are responsible for managing auto-renewal through their respective app store.

Cancellation of Subscription

Users may cancel their subscription at any time via the app marketplace from which the subscription was purchased. Cancellation will stop future billing, but access to subscribed features will continue until the end of the current paid period.

Refund Policy

All subscription payments are final and non-refundable once a subscription is activated. No refunds or credits will be provided for partial usage, unused subscription time, early cancellation, or failure to use the service.

Suspension or Termination

SE Home reserves the right to suspend or terminate access to subscription services without refund in case of misuse, violation of terms, or unlawful activity.

Policy Updates

This policy may be updated from time to time. Continued use of SE Home after any updates constitutes acceptance of the revised policy.
